This matter is taken up through Hybrid mode.

Heard the learned counsel for the petitioner and Mr. P. Behera, the learned counsel appearing for the Transport Departmnet.

The petitioner has filed this writ petition seeking a direction to the opposite party no.2 to accept the tax in respect of the vehicle of the petitioner bearing registration No.KA-09M2424, inasmuch as in spite of the fact that he has paid the tax upto 2017 and thereafter the tax having not been received, he has filed a representation in this regard vide Annexure-3 which is still pending.

Learned counsel for the petitioner submits that though the petitioner has sought for the aforesaid direction in the writ

// 2 // petition, but it would suffice if a direction for disposal of the representation of the petitioner vide Annexure-3 is passed. 5.

Mr. P. Behera, learned counsel appearing for the Transport Department, however, submits that the Authority will consider the representation of the petitioner under Annexure-3 in a time bound manner if it is pending, but no direction need be issued on merit, inasmuch as the case of the petitioner has to be considered in accordance with law.

Considering the aforesaid submission of the learned counsel for the parties, this Court while expressing no opinion on the merit of the representation made vide Annexure-3, directs the opposite party no.2 to take a decision on the representation of the petitioner at Annexure-3 within a period of three weeks from the date of producing / filing the certified copy of this order by the petitioner and intimate the decision thereof to him within a period of ten days of disposal of such representation. 7.

With the aforesaid order, this writ petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
