1. Heard the learned counsels for the Petitioner and the State.
2. By means of this application, the Petitioner seeks grant of bail U/s.438, Cr.P.C. in apprehension of arrest for his alleged involvement in the offences U/s. 493/417/506, I.P.C. read with Sections 66(E) & 67 of the I.T. Act, in connection with Cuttack Mahila P.S. Case No.127 of 2022 corresponding to G.R. Case No.1422 of 2022 pending in the court of learned S.D.J.M. (S), Cuttack.
3. It is alleged that, the accused Binaya Kumar Behera (the present Petitioner) abused the complainant-Informant in filthy languages, threatened her with dire consequences and captured some photographs of the complainant and black-mailed her to make viral of the said photographs in Facebook, etc.
4. Having regard to the nature of allegations and the facts and circumstances of the case, this Court is not inclined to entertain the
// 2 // bail application of the Petitioner. Accordingly, the prayer for anticipatory bail is rejected and the ABLAPL stands dismissed. ( Chittaranjan Dash ) Judge S.K. Parida
