Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 12.11.2020 in connection with Burla P.S. Case No.601 of 2020 corresponding to S.T. Case No.69 of 2021 pending in the Court of learned Sessions Judge, Sambalpur for the alleged commission of offence under Sections 147/148/341/294/323/324/326/307/302/506/149 of IPC. 4.
The prosecution allegation is that several persons jointly assaulted the deceased causing his death. The name of the petitioner does not find place in the FIR. However, some of the eyewitnesses have named him as being one of the assailants. It further appears that the persons whose names have been reflected in the FIR and stand on the similar footing, have been granted bail by the orders passed by this Court in BLAPL No. 8001 of 2021 and BLAPL N o. 4621 of 2021.

In such view of the matter and taking into account the period of detention of the petitioner in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms
and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
