This matter is taken up through Video Conferencing Mode. 2.

Heard the learned counsel appearing for the parties. 3.

This writ petition involves the following prayer. "It is, therefore, prayed that this Hon'ble Court may graciously be pleased to issue Rule NISI calling upon the Opp. Parties to show cause as to why the representation dt.14.12.2021 submitted before the opposite party no.3 (Tahasildar, Raghunathpur) of the petitioners vide Annexure-1 series for institute encroachment case against the opposite party no.5 to 7 and others over the government plot no.1054 of mouza-Chandpur in respect of government Khata no.461 and evict the encroacher over the government plot after due demarcation through tahasil amin or show in sufficient cause to make the rule absolute.

And to pass to such other order/orders and writ/writs which would afford complete relief to the petitioner."

Looking to the limited request involved herein and as this Court finds the representation at the instance of the petitioner on the self same issue vide Annexure-1 series is pending consideration, without expressing any opinion on the merit of the case, this Court disposes of the writ petition directing the opposite party no.3 to look into the grievance of the petitioner vide Annexure-1 series and take decision, as appropriate, following the appropriate provision of law within a period of six months from the date of communication of an authenticated copy of this order along with copy of the writ petition by the petitioner.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout copy of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021 and Court's Office order circulated vide Memo Nos.514 & 515 dated 7th January, 2022.
