Heard learned counsel appearing for the petitioner 3.

This is a writ petition at the instance of the husband for early disposal of C.P.No.33 of 2015, a proceeding under Section 13 of the Hindu Marriage Act pending before the Family Judge, Bhubaneswar. Through the pleading, Mr.Tripathy, learned counsel submitted that the evidence at the instance of the husband long since over. Not only that the respondent-wife has also filed evidence affidavit since 2.9.2021. Even, in spite of such development there is no disposal of the proceeding compelling the husband to come to this Court to have the approach for early disposal of the proceeding. 4.

Considering the submission of learned counsel for the petitioner and on perusal of the order-sheet, this Court finds may be for last one year, the matter could not be progressed for Corona reason or Bar Association seek accommodation keeping in view the Corona. However, taking into consideration the progress already taken involving the proceeding under Section 13 of the Hindu Marriage Act, this Court observes in the event there is no obstruction in conducting the trial of the proceeding and the counsel for the wife agrees to start evidence process involving evidence in affidavit already on record, steps, as appropriate be taken for completing the proceeding at least within a period of six months from the date of communication of an authenticated copy of this order by the petitioner.

The writ petition stands disposed of with the observation and direction made hereinabove.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout copy of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021 and Court's Office order circulated vide Memo Nos.514 & 515 dated 7th January, 2022.
