This matter is taken up through hybrid mode.

The Petitioner in this writ petition seeks to assail the order dated 23rd November, 2021 (Annexure-3) passed by the SubCollector, Kalahandi-Opposite Party No.3 in Mutation Appeal No.01 of 2021.

Although Mr. Panda, learned counsel for the Petitioner advanced argument with regard to maintainability of the second mutation case, i.e. Mutation Case No.2759 of 2016, as well as merit of the order passed in Mutation Appeal No.01 of 2021, but submits that interest of justice will be best served, if the Petitioner files a revision under Section 32 of the Odisha Survey and Settlement Act, 1958 against the impugned order under Annexure-3. He, therefore, prays for withdrawal of the writ petition to avail the statutory remedy.

Considering such submission, this writ petition is disposed of as withdrawn.

Certified copy of the impugned order under Annexure-3 shall be returned to the learned counsel for the Petitioner on substitution of attested photocopy thereof.
