1. This matter is taken up through virtual/physical mode.

2. The petitioner had earlier filed W.P.(C) No.34200 of 2021, which on account of Sale Certificate having been issued in favour of the auction purchaser, was got dismissed as withdrawn on 23.11.2021 to enable the defaulting borrower, i.e., the petitioner herein to seek his remedy before the Debts Recovery Tribunal, Cuttack.

3. Now the present writ petition has been filed, without any change in circumstances, on the ground that due to non-availability of the Presiding Officer, Debts Recovery Tribunal, Cuttack is non-functional.

4. At the time of hearing, learned counsel for the petitioner, in the light of the Presiding Officer having been appointed to the office of the DRT, Cuttack, does not

5. In view of the above, the writ petition is dismissed as withdrawn with the aforesaid liberty.
