This matter is taken up through hybrid arrangement (virtual/physical) mode.

The judgment passed by this Court on 25.01.2022 in SAO No.04 of 2021, whereby the judgment dated 27.09.2021 passed by the learned 2nd Additional District Judge, Berhampur in RFA No.27 of 2018 has been set aside. In this Appeal also, the legality and propriety of that very judgment dated 27.09.2021 have been questioned and assailed in saying that the same cannot be sustained since the judgment impugned in this Appeal has by now been set aide in an earlier Appeal, the prayer in the present Appeal does no more survive for consideration. Accordingly, the Appeal stands disposed of.
