This matter is taken up through Video Conferencing mode. 2.
Heard Mr.S.K.Mishra, learned counsel for the Petitioner. 3.
Mr.Mishra, learned counsel for the Petitioners submits that he does not want to press this application and seeks liberty to file an appropriate application in C.S.No.173 of 2003-I pending in the Court of the learned Additional Civil Judge (Senior Division), Balasore. 4.
The CMP is disposed of as withdrawn. However, the Petitioner is granted liberty to move an appropriate application in the aforesaid pending matter and in the event any such application is filed, the Court below shall consider the same strictly in accordance with law. 5.
The CMP is accordingly disposed of.

As the restrictions due to resurgence of COVID -19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in
