Heard Mr. J.K. Mishra-2, learned counsel for the petitioner and Mr. S. Rath, learned Addl. Standing Counsel appearing for the StateOpposite Parties. 3.

The petitioner has filed this writ petition seeking direction to the opposite parties to admit him in MBBS course as per his rank. 4.

Mr. J.K. Mishra-2, learned counsel for the petitioner contended that in NEET All India Entrance Examination, the rank of the petitioner is 36488, as has been indicated in Annexure-2. But one Pravati Lenka, whose NEET All India rank is 41499, has been selected and admitted into the course by the authority, ignoring the All India rank of the petitioner.

As it appears, the petitioner wants to get a seat in MBBS course and it is contended that the candidate below his rank, namely, Pravati Lenka, got admission ignoring his All India rank. But the petitioner has not made her as a party to the proceeding. Therefore, due to nonjoinder of proper party, the writ petition filed by the petitioner is not maintainable. Apart from the same, in the meantime, admission into MBBS course has already been over and classes have started. Therefore, if any order is passed in the writ petition, it will dislocate the entire admission process.
