Heard learned counsel for the petitioner and learned counsel for the State.

Instant petition under Section 482 Cr.P.C. is filed by the petitioner for quashing of the criminal proceeding in T.R. Case No.47 of 2021 corresponding to Naktideul P.S. Case No.59 of 2021 pending in the file of learned Special Judge-cum-Additional Sessions Judge, Rairakhol, Sambalpur on the grounds stated therein. 3.
Learned counsel for the petitioner does not press the matter on merits. However, it is submitted by Mr. Mohanty that on the strength of confessional statement of co-accused, the petitioner has been implicated and at present, since the investigation is underway, he is likely to be apprehend by the local police and therefore, direction be made for consideration of bail on merit. 4.
In view of the above submission, the CRLMC stands disposed of with a direction to the petitioner to surrender on or before 28th September, 2022 before Special Judge-cum-Additional
Sessions Judge, Rairakhol, Sambalpur in connection with T.R. Case No.47 of 2021 arising out of Naktideul P.S. Case No.59 of 2021 and in the event of his surrender, Court shall consider his plea for bail on merits and pass appropriate order on the same day as per and in accordance with law and keeping in view the principle of parity.
