Heard learned counsel appearing for the parties. 3.

This case involves a direction for removal of encroachment. Undisputedly, there is already an application pending before the Tahasildar, Kujang-opposite party no.2 and as per the endorsement at the top of such application, it appears, the Tahasildar has already directed to the Revenue Inspector to visit, enquire and submit report. In the event of pendency of any such application, action, as appropriate, be taken however, keeping in view the provision under the O.P.L.E. Act and also involving the parties likely to be affected by completing the entire exercise within a period of four months from the date of communication of an authenticated copy of this order by the petitioner.

The writ petition stands disposed of with the observation and direction made hereinabove.
