This matter is taken up by virtual/physical mode. 2.

The Petitioner, i.e. Sahoo Bartan Bhandar is a proprietorship concern of Sri Gajendra Sahoo, son of Narendra Sahoo, and by filing the present writ petition has challenged the Demand Notice dated 8th November, 2021 issued under Section 13(2) of the SARFAESI Act, 2002 seeking to recall and outstanding loan amount of Rs.16,32,770/- on account of the Cash Credit limit facility having been declared NPA on 30th April, 2021 by the State Bank of India, Attabira Branch in the district of Bargarh.

At the time of hearing, Mr. Kar, counsel for the Bank submits that the Petitioner has the option of depositing an amount of Rs.3,28,712/- as the amount overdue as on 31st March, 2022 in the loan account concerned, and thereby regularize the said account.

Mr. Rath, counsel for the Petitioner prays for permission to withdraw the writ petition to enable the

// 2 // Petitioner to get its account upgraded to a standard account on deposit of the aforesaid amount overdue before 31st March, 2022.

In view of the above, the writ petition is dismissed as withdrawn with liberty as aforesaid.
