1. This matter is taken up by virtual/physical mode.
2. The Petitioner is desirous of obtaining a licence for IMFL "ON" Shop at Nilabati Restaurant of the Petitioner situated at the stated place in Nuagarh (Barakul), District-Khurda. His application not being in the statutory format i.e. Form No.XI-B in terms of Rule 51(1) of the Odisha Excise Rules, 2017 and also not addressed to the Collector concerned, has not been considered.
3. At the time of hearing, in view of the aforesaid objection by the State, learned counsel for the Petitioner prays for permission to withdraw the present writ petition to enable his client to make a proper
// 2 // application as per the provisions of the Odisha Excise Rules, 2017.
4. In view of the above, the Writ Petition is dismissed as withdrawn with the aforesaid liberty.
