Heard learned counsel for the Petitioner and learned counsel for the State.

This is an application under Section 389(2) read with Section 439 of Cr.P.C for bail pending disposal of the Criminal Appeal No.25 of 2022 before the learned Sessions Judge, Nayagarh. 3.

Learned counsel for the Petitioner submits that during pendency of criminal appeal before the court below, the Petitioner has suffered incarceration about eleven months and he has neither committed any overt act nor misused the trust reposed in him during the currency of bail.

Considering the same and taking note of the tenor of deposition of P.W.1, this Court directs the Petitioner to be released on bail. Terms of release to be fixed by the learned trial court. 5.

Accordingly, the CRLMA stands disposed of.
