Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 14.07.2022 in connection with Special Case No. 176 of 2022 corresponding to P.R.No. 49 of 2022-23 pending in the Court of learned Special Judge, Balasore for the alleged commission of offence under Section 21(b)(ii)(B) of NDPS Act.

Having regard to the fact that the seized contraband is less than commercial quantity weighing 16 grams of Ganja, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of

posting of the case without fail.

The BLAPL is accordingly disposed of.
