Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 29.11.2022 in connection with Saheed Nagar P.S. Case No. 558 of 2022 corresponding to C.T. Case No. 7288 of 2022 pending in the Court of learned JMFCIII, Bhubaneswar for the alleged commission of offence under Sections 465/467/468/471/34 of IPC.

It is alleged that one Sri Ashok Kumar Acharya applied before the Odisha Pharmacy Council for registration as Pharmacist. During inquiry it was found that the Diploma certificate in Pharmacy submitted by him is a fake. Accordingly, an FIR was lodged and the case was registered. During interrogation, the said Ashok Kumar Acharya is said to have confessed that the fake
certificate was given to him by the present petitioner on payment of Rs.1,80,000/-. Thus, it is seen that the petitioner has been implicated solely on the basis of the statement of the co-accused and there is no other independent material against him. 5.
Having regard to the above facts, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
