Heard learned counsel for the Petitioner and the learned counsel for the State.

The Petitioner being in custody in C.T. Case No.39 of 2019, arising out of Phulbani Sadar P.S. Case No.67 of 2019 pending in the court of learned Sessions Judge-cum-Special Judge, Phulbani, has filed this petition for his release on bail. The offence alleged against the Petitioner is punishable under Section 20(b)(ii)(B) of the N.D.P.S Act.

Learned counsel for the Petitioner submits that the Petitioner is in custody since 29.11.2021 after rejection of his prayer for bail inasmuch as he did not appear on the date fixed for trial.

Considering the facts and the submissions made, especially the fact that the Petitioner undertakes to appear on the date when the case is posted for trial, this Court directs that the Petitioner be released on bail in the aforesaid case by the court in seisin over the matter on such terms and conditions as deemed just and proper including the aforesaid condition. Violation of the condition shall entail cancellation of bail granted pursuant to this order.

The BLAPL is, accordingly, disposed of being allowed. 7.
Urgent certified copy of the order be granted on proper application.
