The present Writ Petition has been filed with the following prayer:- " It is therefore prayed that in the facts and circumstances stated above and in the interest of justice this Hon'ble Court may pleased to issue notice to the Opposite Party and after hearing both the Parties be pleased to issue Writ/Directions/Declaration to the Opposite bank to (i) Recall the E-Auction sale notice dated 06.12.2022 and subsequent publishing the same in the Samaj, dated 13.12.2022 of sale of mortgaged residential building at DistrictJajpur, Tahasil-Balichandrapur, MouzaKusupur, Khata No.815/210, Plot No.796,797,799, Area: A.0.140 dec., KisamHomestead. (ii) To consider the representation/letter of the petitioner applied through the guarantor of the loan account before the opposite party bank on 16.12.2022 by closing the loan account of the

petitioner accepting the outstanding of Rs.15,25,000/- in three instalments.

And pass such other orders/issue such other directions as this Hon'ble Court may deem proper to secure the ends of justice.

In course of hearing, learned counsel for the Petitioner states that highlighting his grievances, the Petitioner has made a representation to Opposite Party vide Annexure-5 and the same may be directed to be considered within a stipulated time, to which learned Counsel for the State has no objection. 5.

As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party to consider the representation filed by the petitioner vide Annexure-5 and pass appropriate order in accordance with law within a period of four weeks from the date of production of certified copy of this order.

Issue urgent certified copy as per Rules.
