Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 19.10.2022 in connection with Rajgangpur P.S. Case No.87 of 2010 corresponding to Special G.R. Case No.179(B) of 2010 pending in the Court of learned J.M.F.C., Rajgangpur for the alleged commission of offence under Sections 395/435 of IPC.

It is alleged that on 11.05.2010 a mob comprising of 60 to 70 persons being armed with several weapons entered inside the Langiberna mines and committed robbery of different articles and also set fire to be conveyor belt of the mines. In the original trial the accused persons have been acquitted. This is a split of case. 5.

Having regard to the nature of accusations and the fact that the co-accused persons have been acquitted in the original trial, I am

inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
