This matter is taken up through hybrid mode.

Heard Mr. K. Rath, learned counsel for the Petitioner and Mr. S.N. Nayak, learned Additional Standing Counsel appearing for the State.

The Petitioner has filed this Writ Petition seeking direction to restrain the discriminatory action for exemption of EMD and ISD in favour of handicapped persons reflected in the annexure 5 and 6 series which contravening OPWD Code appendix- XXXIII 2005. 4.
In course of hearing, learned counsel for the Petitioner states that highlighting the grievances, the Petitioner has made a representation to Opposite Party No.1 vide Annexure-7 and the same may be directed to be considered taking into account annexures 5 & 6 within a stipulated time, to which learned counsel for the State has no objection.

As agreed to by learned counsel for the parties, this Court,
without expressing any opinion on the merits of the case, disposes of the writ Petition directing opposite party No.1 to consider the representation filed by the Petitioner vide Annexure-7, taking into account annexures 5 & 6 and pass appropriate order in accordance with law within a period of six weeks from the date of production of certified copy this order.
