This matter is taken up through Video Conferencing mode. 2.

It is submitted by Mr.Mishra, learned counsel for the Petitioner that in a pending suit bearing C.S.No.488 of 2004 the Petitioner has filed I.A.No.11 of 2013 alleging violation of the Court's order under Order 39 Rules 1 & 2 of the Code of Civil Procedure. It is stated by Mr.Mishra, learned counsel for the petitioner that the same is pending till date.

Mr.Mishra, learned counsel for the Petitioner seeks a direction from this Court to direct the trial court to dispose of the matter within a stipulated period of time. In the facts and circumstances stated herein above and considering the delay in disposal of the interlocutory application, this Court disposes of the CMP without expressing any opinion on the merits of the matter with direction to

// 2 // the learned Civil Judge (Junior Division), Baripada to dispose of I.A.No.11 of 2013 within a period of three months from the date of production of an authenticated copy of this order. 4.

With the aforesaid observation the CMP stands disposed of. 5.

As the restrictions due to resurgence of COVID -19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Court's Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
