This matter is taken up by video conferencing mode. Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Angul Sadar P.S. Case No.722 of 2021 corresponding to G.R. Case No.1604 of 2021 pending in the Court of learned S.D.J.M., Angul for the commission of the alleged offences punishable under sections 498-A, 304-B, 306/34 of the Indian Penal Code read with section 4 of the D.P. Act.

Perused the first information report annexed to the anticipatory bail application.

Learned counsel for the petitioner submitted that the petitioner is the father-in-law of the deceased and he was staying separately from the deceased when the deceased

// 2 // committed suicide and the present case has been foisted against the petitioner at the instance of the brother of the deceased and there are no material against the petitioner to constitute the ingredients of the offences under sections 304-B or 306 of the Indian Penal Code and therefore, the anticipatory bail application may be favourably considered. Learned counsel for the State opposed the prayer for anticipatory bail.

Considering the submissions of the learned counsel for the respective parties, while not inclining to grant anticipatory bail to the petitioner, liberty is granted to the petitioner to surrender and move for bail in the Court below within a period of four weeks, in the event of which the learned Courts below shall dispose of the same in accordance with law expeditiously. The case records shall be made available to the Court concerned for disposal of the bail application.

The ABLAPL stands disposed of.
