This matter is taken up through Video Conferencing mode. 2.

Challenging the order dated 5th November, 2021 passed in C.S.,No.1510 of 2020 by the learned Civil Judge (Senior Division), Bhubaneswar, the Petitioners approached this Court by filing the present CMP.

Heard Mr.Panda, learned counsel for the Petitioners and Mr.R.C.Rath, learned counsel appearing for Opposite Party Nos. 1 and 2.

Mr.Panda, learned counsel for the Petitioners submits that although there is no allegation against defendant Nos.11 and 12, who are the Petitioners in the present CMP and they have been aided as parties in the suit, therefore, he had filed an application under Order 1 Rule 10(2) of the Code of Civil Procedure for deletion of their names from the cause title of the suit.

Mr.Rath, learned counsel appearing for Opposite Party Nos. 1 and 2 opposes the prayer made by the Petitioners. 6.

Having heard learned counsel for the parties, this Court feels that interest of justice will be best served if a direction is given to the learned trial Court to dispose of the suit within a stipulated period of time.

Accordingly, learned Civil Judge (Senior Division), Bhubaneswar is directed to make all efforts to dispose of C.S.No.1510 of 2020 within a period of six months from today. 7.

With the aforesaid observation the CMP stands disposed of. 8.

As the restrictions due to resurgence of COVID -19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Court's Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
