The present writ petition has been filed by the Petitioner seeking for a direction to the Opposite Parties to pay the enhanced Grade Pay of Rs.6,600/- as 3rd RACP benefit w.e.f. 08.06.2015 under Revised Assured Career Progression Scheme (RACPS) as per the Finance Department, Govt. of Odisha Resolution No.9769 dated 08.06.2015.

Hear learned counsel for both the parties.

It is submitted by learned counsel for the Petitioner that her case is covered by a decision of this Court rendered in the case of Archana Kanhar vs. State of Odisha and others (W.P.(C) No.39167 of 2021 disposed of on 20.12.2021.

Mr. Mund, learned Additional Government Advocate for the State submits that he has no objection if the representation of the Petitioner is considered in accordance with law.

Having heard learned counsel for both the parties, this Court without expressing any opinion on the merits of the case disposes of the writ petition with a direction to the Petitioner to file a fresh representation taking all the grounds available to him in law and the order of this Court as relied on by the Petitioner. If such a representation is filed within a period of two weeks from today, Opposite Party No.1 shall do well to dispose of the same in accordance with law taking into consideration the order of this Court in the case of Archana Kanhar (supra) within a period of three months from the date of such representation, if there is no other legal impediment. However, the decision so taken be communicated to the Petitioner within a period of ten days from the date of such decision. 6.

With the aforesaid direction, the writ petition stands disposed of.
