This matter is taken up through video conference mode. Order No.

The Writ Petition involves the following prayer :- "It is, therefore, prayed that in the interest of justice, this Hon'ble Court may graciously be pleased to admit this writ application, issue Rule Nisi, calling upon the opp.parties to show cause as to why the Opposite Parties is shall not be directed to record the land vide Plot No.927 of MouzaDaitadasahi in the name of the Petitioner by following due procedure.

And if the Opp.Parties failed to show cause or show insufficient cause/irrelevant cause, then make the said rule nisi absolute.

And pass any other order/orders direction/s as may deem fit and proper in the facts and circumstances of the case.."

This Court however finds, by way of Writ Petition, the Petitioner seeks compliance of the order of the Competent Authority dated 14.2.2008, vide Annexure-4. The Petitioner takes a stand that earlier the litigation process involved her husband, who has died in 2017, and therefore, there is some delay on bona fide reason. This Court though finds, the Writ Petition seeks direction for compliance of the order dated 14.2.2008 in an attempt in the year 2022, considering the rival contentions of the Parties, the Writ Petition stands disposed of observing, in the event there is no legal impediment by way of challenge to the order dated 14.2.2008 as of now, on an application being filed along with copy of the order of this Court by the Petitioner, the direction involving the order dated 14.2.2008 shall be worked out by O.P.2 by completing the entire exercise within a period of two months from the date of communication of this order.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the Parties may utilize a printout of the order available in the High Court's Website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587 dated 25th March, 2020, modified by Notice No.4798 dated 15th April, 2021 and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
