The present writ petition has been filed by the Petitioner seeking for a direction to the Opposite Parties to extend the benefit of the judgment dated 27.06.2017 passed in W.P.(C) No.20648 of 2016 (Dr. Karunakar Sahoo vs. State of Odisha and another) decided by a Division Bench of this Court on 27.06.2017. 2.

It is submitted by Mr. Pattanaik, learned counsel for the Petitioner that the case of the Petitioner is similar to that of the Petitioners in the above noted judgment of this Court and accordingly prays for a direction to the Authority to consider the case of the Petitioner in the light of the judgment in the case of Dr. Karunakar Sahoo (supra).

Mr. Praharaj, learned Standing Counsel for State has no objection, if a direction is given to the Authority for considering the case of the Petitioner in the light of the judgment in the case of Dr. Karunakar Sahoo (supra).

Having heard learned counsel for the Parties and without expressing any opinion on the merits of the case, this Court disposes of the writ petition with a direction to the Petitioner to make a fresh representation before the Director, Higher Education Department, Opposite Party No.2 within a period of two weeks from today along with a copy of the judgment referred to hereinabove. In the event such representation is filed before the Opposite Party No.2 within the stipulated time, Opposite Party No.2 shall dispose of the same within a period of three months from the date of presentation of such representation taking into consideration the judgment cited supra by passing a reasoned and speaking order. Any decision taken on such representation shall be communicated to the Petitioner within a period of ten days thereafter.

With the aforesaid observation, the writ petition stands disposed of.
