Heard Mr. A.K. Pradhan, learned counsel for the Appellant and Mr. S. Mohanty learned counsel for the Respondent No.1.

It is fairly submitted by both the counsel appearing for the parties that in view of the amendment carried out to Section- 16 of The Odisha Civil Courts (Amendment) Act, 2014 as against the impugned order, appeal will lie to the learned District Judge.

Accordingly, Mr. Pradhan, learned counsel for the Appellant wants to withdraw the present appeal in order to approach the learned District Judge, Jagatsinghpur. Accepting such prayer, the appeal is disposed of with liberty to the appellant to move before the learned District
