This matter is taken up through Video Conferencing mode. 2.

The short grievance of the Petitioner in the present writ application is that she has submitted a representation on 7th December, 2021 before the District Education Officer, Nayagarh, Opposite Party No.3 and the same is pending as of now. 3.

It is submitted by the learned counsel for the Petitioner that the Petitioner is not allowing to discharge her duties by the School authority.

Mr.Jena, learned Standing Counsel for School & Mass Education Department submits that he has no objection if a direction is given to the Opposite Party No.3 to consider the grievance of the Petitioner stated to be pending before him.

Having heard learned counsel for the parties, this Court disposes of the writ application with a direction to the Opposite Party No.3 to consider the representation of the petitioner dated 7th

// 2 // December, 2021 pending before Opposite Party No.3 within a period of eight weeks from the date of production of certified/authenticated copy of this order. It is open to the Petitioner to take any other grounds available to her including the ground regarding not allowing her to discharge the duties before the authority. The Opposite Party No.3 shall consider the case of the Petitioner and dispose of the same by passing a speaking and reasoned order. The decision so taken be communicated to the Petitioner within 10 days thereafter. 6.

It is made clear that this Court has not expressed any opinion on the merits of the case.

With the aforesaid observation, the writ application stands disposed of.

As the restrictions due to resurgence of COVID -19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Court's Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
