Mr. Tripathy, learned advocate appears on behalf of petitioner and submits, damage was caused to his client's property. His client made representation dated 14th December, 2021 to the Tahasildar (opposite party no.5). Prayer is for, inter alia, compensation being granted.

Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of State and submits, this Bench does not have assignment since compensation is prayed under Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

The prayer is for direction to pay compensation as claimed in the representation. Petitioner seeks valuation of the damage as per provisions in the 2013 Act. As such, this case does not fall under entry 2 in assignment list of the Division Bench presided over by Hon'ble Mr. Justice, Biswajit Mohanty.

Opposite party no.5 will deal with the representation dated 14th December, 2021(annexure-6). Petitioner must be informed of the decision taken within four weeks of communication. 5.
