This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Challenging the order of transfer and the order relieving the Petitioner, the present Writ Application has been filed by the Petitioner, who was working as Assistant Teacher in Khamarsahi Nodal High School.

It is submitted by the learned counsel for the Petitioner that although he has already approached the appellate authority by filing an appeal as well as an application for seeking interim relief, the same is pending before the Director, Elementary Education, Orissa, Opposite Party No.2.

Considering the limited nature of grievance, this writ application is being disposed of with a direction to the Director, Elementary Education, Opposite Party No.2 to consider and dispose of the appeal stated to be pending before him within a period of four

// 2 // weeks from today. Further, the Opposite Party No.2 shall consider the interim application within a period of seven days from the date of production of certified copy of this order.

It is needless to mention here that the appellate authority shall provide an opportunity to the Petitioner-appellant to present his case. Any decision taken in the appeal shall be communicated to the Petitioner forthwith.

As an interim measure, the impugned order of transfer shall not be given effect to if the same has not yet been given effect to till disposal of the interim application.

It is made clear that this Court has not expressed any opinion on the merits of the case.

With the aforesaid observation, the writ application stands disposed of.
