Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties to treat the petitioner at par with the employees of other aided educational institutions who were extended with grant-in-aid in accordance with Grant-in-Aid Order, 1994 and accordingly extend all benefits as applicable to the aided educational institution within the meaning of Sec.3(6) of the Orissa Education Act, such as earned leaves as prescribed under Rule 9 of 1977 Rules, Extraordinary leaves as prescribed under Rule 12 of 1977 Rules, as well as study leaves as prescribed under Rule 13 of 1977 Rules and other benefits as provided under 1977 Rules, Old Pension Rules, GPF Rules, though same facilities and benefits were given to the other institutions, which were notified under Section 3(b) of the Orissa Education Act pursuant to the Grant-in-Aid Order, 1994. 4.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to the opposite party no.1 vide Annexure-2 and the same may be directed to be disposed of within a stipulated

time, taking into consideration Annexure-3, to which learned State counsel has raised no objection.

As agreed to by learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing the opposite party no.1 to consider the representation filed by the petitioner vide Annexure2 and pass appropriate order in accordance with law, taking into consideration Annexure-3, within a period of three months from the date of production of authenticated/certified copy of this order.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No. 4798 dated 15th April, 2021 and Court's office order circulated vide Memo Nos. 514 and 515 dated 7th January, 2022.
