This interlocutory application has been filed by the petitioner for modification of order dated 04.01.2022 passed in W.P.(C) No. 41700 of 2021.

Considering the averments made in the application itself and after hearing learned counsel for the petitioner, the order dated 04.01.2022 passed in W.P.(C) No.41700 of 2021 is recalled and fresh order is passed in W.P.(C) No. 41700 of 2021. 4.

Heard learned counsel for the petitioner.

Let a copy of the writ petition be served within three days on Mr. S.K. Patra, learned Standing Counsel appearing for opposite party no.6. 4.

The petitioner has filed this writ petition seeking direction to the opposite parties to sanction & disburse the pension and other retirement benefits in his favour taking into account the service rendered by him under the regular so also work-charge & DLR service periods in order to be eligible to get the minimum pension and with all other retiral benefits keeping in view the judgment of this Court under Annexure-7 so also in view of the pension papers forwarded by opposite party no.3 as per Annexure-10 series within a stipulated period. 5.

In course of hearing, learned counsel for the petitioner states that the pension papers of the petitioner has already been recommended and forwarded by the opposite party no.3 to the opposite party no.6 vide Annexure-10 series and, therefore, direction may be given to the opposite party no.6 to take a decision on the same and pass appropriate orders taking into consideration Annexure-7 within a stipulated time. 6.

Considering the limited nature of grievance of the petitioner, this Court disposes of the writ petition directing opposite party no.6 to take a decision on the pension papers of the petitioner which has been recommended and forwarded by opposite party no.3 under Annexure-10 series, and pass appropriate order in accordance with law taking into consideration Annexure-7, as expeditiously as possible, preferably within a period of three months from the date of receipt of certified/authenticated copy of this order.

As the restrictions due to resurgence of COVID-19 situation are

continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
