This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

By filing the present writ application, the Petitioner seeks for a direction to the Principal Secretary to Government in the Department of School & Mass Education, Odisha, Opposite Party No.1 to take a decision on the representation submitted by the Petitioner on 15th October, 2021. Under Annxure-9. 3.
It is submitted by the learned counsel for the Petitioner that the said representation has been filed pursuant to the order passed by the State Commissioner for Persons with Disabilities, Odisha in SCPD Case No.79 of 2021. Mr.Mohapatra, learned counsel for the Petitioner draws the attention of the Court to Paragraph-9 of the order passed by the learned State Commission for Persons With Disabilities, Odisha in SCPD Case No.79 of 2021 which is as follows:
"As the joint Enquiry report has been submitted to the
// 2 // D.E.O., Khordha and the Complainant alleges that presence of Sri Antaryami Dash, Jr.Asst. in the office of DEO, Khordha could cause further damage to her Service Book and also on her service prospect as her service is a District Cadre Post, the D.E.O., Khordha is requested to consider such allegation of the complainant and take suitable action to allay the apprehension of the complainant. If the complainant is aggrieved on the findings of the joint enquiry report and the action of DE.O., Khordha, she (Complainant) may take recourse to higher administrative authority of the DEO, Khordha." 4.
Accordingly, the Petitioner had approached the Opposite Party No.1 by filing a representation dated 15th October, 2021. It is further submitted that the said representation is till pending before the Opposite Party No.1.

Mr.S.Jena, learned Standing Counsel for School & Mass Education Department submits that he has no objection if a direction is given to the Opposite Party No.1 to consider the representation of the Petitioner dated 15th October, 2021.

Having heard the learned counsel for the parties, this Court disposes of the writ application with a direction to the Opposite Party No.1 to consider the representation of the Petitioner dated 15th October,2021 if any, pending before him to consider the same in accordance with law within a period of six weeks from the date of production of certified copy of this order.

It is needless to mention here that the Opposite Party No.1 shall pass a speaking and reasoned order. The decision so taken shall be communicated to the petitioner within 10 days from the date of such decision.

This Court has not expressed any opinion on the merits of the

With the aforesaid observation, the writ application stands disposed of.
