Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking to quash the order under Annexure-7 and to direct the opposite parties to consider his case for promotion to the Cadre of Level-IV as he satisfied all the eligibility criteria prescribed under Odisha Elementary Education (Method of Recruitment and Conditions of Service of Teachers and Officers) Rules, 1977 read with amendment Rule, 2019 as well as the notifications dated 03.08.2021 and 14.09.2022. 4.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to the opposite party no.2 vide Annexure-8 and the same may be directed to be disposed of within a stipulated time, taking into consideration Annexure-6, to which learned Standing Counsel for School & Mass Education Department has raised no objection.

As agreed to by learned counsel for the parties, however, without expressing any opinion on the merits of the case, this writ petition stands disposed of directing the opposite party no.2 to consider the representation filed by the petitioner vide Annexure-8, taking into consideration Annexure-6 and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order. Issue urgent certified copy as per rules.
