This matter is taken up through hybrid mode.

Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties to extend the benefit of 3rd RACP in his favour from 01.01.2006 and to extend the financial benefits to him till age of superannuation, i.e. 31.03.2006 and accordingly, to release the arrear salary of the petitioner for such period, so also fix the retiral benefit in his favour taking the last pay so drawn without any further delay, in view of the fact that he is an old man over the age of 74 years and the entire family of the petitioner are dependent on him. 4.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to the opposite party no.3 vide Annexure-7 and the same may be directed to be disposed of within a stipulated time, to which learned Standing Counsel for School & Mass Education Department has raised no objection. 5.

As agreed to by learned counsel for the parties, however, without expressing any opinion on the merits of the case, this writ petition stands disposed of directing the opposite party no.3 to consider the representation filed by the petitioner vide Annexure-7 and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order.

Issue urgent certified copy as per rules.
