This matter is taken up through video conference mode. Order No.

It is alleged that the Berhampur Municipal Corporation is not undertaking the exercise in terms of the direction of the Hon'ble Green Tribunal, Bench at Kolkata. Learned counsel for the Petitioners submitted that the Petitioners cannot be treated as encroachers and there is illegal action by the B.M.C. on wrong interpretation of the direction of the Hon'ble Green Tribunal. 3.
For the operation of the order of the Hon'ble Green Tribunal, for the opinion of this Court, the Petitioners, if so advised, may approach the Hon'ble Green Tribunal for intervention in the action of the B.M.C., if any, in contravention of the order of the Tribunal.

Learned counsel for the Petitioners at this stage of the matter seeks withdrawal of the Writ Petition with the liberty to move the Hon'ble Green Tribunal.

This matter thus stands disposed of as withdrawn but however with liberty as prayed for.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the Parties may utilize a printout of the order available in the High Court's Website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587 datred 25th March, 2020, modified by Notice No.4798 dated 15th April, 2021 and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
