Heard the learned counsel appearing for the parties. 2.

Annexure-4 appears to be an application in the matter of vacation of encroachment pending before the Tahasildar, TangiChoudwar-opposite party no.3. In the event of pendency of such application, same may be considered keeping in view the provision under the O.P.L.E. Act and this Court observes in the event there is already initiation of encroachment proceeding, the same may be concluded under the provision of O.P.L.E. Act but, however. providing opportunity to the parties likely to be affected by completing the entire exercise within a period of six months from the date of communication of certified copy of this order by the petitioner.

The writ petition stands disposed of with the observation and direction made hereinabove.
