The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered against him vide FIR No. 248 dated 06.10.2021, under Sections 3, 4, 5, 6 and 7 of the Immoral Traffic Prevention Act, 1956, registered at Police Station City South, Moga, District Moga.

At the time of issuance of notice of motion, the following order was passed by this Court on 5.1.2022:

"Heard through video conferencing.

- 2 - The petitioner is seeking anticipatory bail in FIR No. 248 dated 06.10.2021, under Sections 3, 4, 5, 6 and 7 of the Immoral Traffic Prevention Act, 1956, registered at Police Station City South, Moga, District Moga.

Learned counsel for the petitioner contends that it is alleged that on the basis of secret information a raid was conducted at the hotel and two persons were apprehended, as they were stated to be indulging in immoral activities. The two persons who were apprehended were adults. It is alleged that the petitioner along with co-accused Gurpreet Singh had fled away. He, however, contends that it would not be possible for the petitioner to have run away in the presence of several police personnel. He also contends that coaccused Gurpreet Singh has already been granted anticipatory bail by this Court by order dated 10.12.2021 passed in CRM-M No. 43925 of 2021.

Issue notice to the respondent.

At the asking of the Court, Mr. Dhruv Dayal, Senior DAG, Punjab, accepts notice on behalf of the respondentState. List on 08.02.2022.

In the meantime, the petitioner is directed to appear before the investigating/arresting officer and join investigation.

In the event of his arrest, the investigating/arresting officer shall release the petitioner on ad interim bail subject to his satisfaction. The petitioner shall also abide by the conditions as envisaged under Section 438 (2) Cr.P.C." 3.

Learned State counsel has informed that the petitioner pursuant to interim directions has joined investigation and is not required for any custodial interrogation and that he is not involved in any other case.

Having regard to the aforestated position wherein the petitioner has joined investigation and is not required for any custodial interrogation and not even wanted in any other case, the petition is accepted and interim directions issued by this Court vide order dated 5.1.2022 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C. 08.2.2022 (GURVINDER SINGH GILL) Mohan JUDGE Whether speaking /reasoned Yes / No Whether Reportable Yes / No
