******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 33 dated 15.4.20-16 registered for the offence punishable under Sections 341, 457, 379-B (1) of IPC at Police Station Hatur, District Ludhiana (Rural).

Heard.

Learned counsel for petitioner submits that petitioner had been regularly appearing before the trial court but could not appear on 7.12.2018 when his bail bond and surety bonds were cancelled and forfeited to the State.

Learned State counsel submits that as per order dated 9.1.2019, petitioner has appeared before the trial court and has been allowed interim bail. Keeping in view the fact that the petitioner had surrendered before the trial court, this petition is allowed and the order allowing him interim bail is affirmed subject to deposit of `5000/- as state expenses for non-appearance of petitioner on the date three witnesses were present. The amount be deposited within two weeks. On deposit of this amount, order dated 9.1.2019 allowing him interim bail shall be deemed as affirmed. In the event of petitioner failing to deposit `5000/- within stipulated period, he shall be taken into custody.
