M/S Ajit Construction v. State Of Punjab & ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
Arbitration Case No.122 of 2015 (O&M) DATE OF DECISION: 05.02.2016 M/s Ajit Construction Co.
.....Petitioner versus State of Punjab and others .....Respondents CORAM:- HON'BLE MR.JUSTICE S.J. VAZIFDAR, ACTING CHIEF JUSTICE Present: Mr. Sumit Gupta, Advocate for the petitioner Ms. Minakshi Goyal, AAG, Punjab ..
S.J. VAZIFDAR, ACTING CHIEF JUSTICE (Oral):
This is an application under Section 11 of the Arbitration and Conciliation Act, 1996, for appointment of a sole Arbitrator.
2.
The parties had entered into a construction contract. Disputes and differences having arisen between the parties, the petitioner invoked the arbitration clause, inter alia, by appointing an Arbitrator. The respondents are not agreeable to the nominee being appointed as a sole Arbitrator. The clause, in that event, provides for an Arbitral Tribunal consisting of three Arbitrators. The parties have, however, requested me to appoint a sole Arbitrator with a view to saving cost and time. 3.
In the circumstances, Mr. Justice M.S. Liberhan, former Chief Justice of the Andhra Pradesh High Court, is appointed as a sole Arbitrator.
4.
The petition is accordingly disposed of.
