* * * * S.J. VAZIFDAR, A.C.J. (ORAL) This is a petition for the appointment of an arbitrator. 2.

The petitioner and respondent No. 1 had entered into an agreement of employment. Clause 9 thereof contains an arbitration agreement. The respondent No. 2 is the Managing Director of the 1st respondent - company, whereas respondent No. 3 is the investor/share holder in the 1st respondent - company. They are not parties to the arbitration agreement. 3.

The petition against respondents No. 2 and 3 is dismissed. 4.

The disputes and differences between the petitioner and respondent No. 1 - company must be referred to arbitration. 5.

In these circumstances, the petition is disposed of by appointing Mr. Justice R.P. Nagrath, former Judge of this Court, as the sole arbitrator in respect of the disputes and differences between the petitioner and respondent No. 1 only.

The parties have agreed that the venue shall be at the Chandigarh Arbitration Centre.

The arbitrator, however, shall not enter upon reference till 01.04.2016. In the meantime, the parties shall approach the High Court Mediation Centre to try and resolve the disputes. They shall attend the High Court Mediation Centre in the first instance on 17.02.2016 at 11.00 AM and thereafter as directed by the Mediator.
