(ORAL) This is a petition under section 11(6) of the Arbitration & Conciliation Act, 1996 (for short 'the Act') for appointment of a sole arbitrator to adjudicate the disputes and differences between the parties.

The parties had entered into an agreement dated 05.10.2011. The petitioner is a partnership firm consisting of three partners, namely, Ashok Kumar Mehta, Ashish Kumar Mehta and Smt. Kanupriya Mehta. Ashok Kumar Mehta is also a partner in another firm M/s Ashok Kumar and Sushil Kumar. Sushil Kumar Mehta and two others are also partners in this firm. The agreement in question has an arbitration clause. The disputes relate inter-alia to accounts. One of the disputes pertains to the respondents having debited the amounts allegedly due to Ravinder Sharma 2017.03.15 15:39 I attest to the accuracy and authenticity of this document

Arbitration Case No. 142 of 2016 [2] them from the petitioner in respect of another contract entered into between the respondents and the firm M/s Ashok Kumar and Sushil Kumar. The arbitration proceedings in respect of that contract are already pending. The disputes relating to accounts are also referable to arbitration. It would, however, be convenient to refer the disputes under this agreement also to the same learned arbitrator.

In the circumstances, the petition is disposed of by appointing Mr. Rajnish Sharma, Additional General Manager (I), Hafed Corporate Office, Sector 5, Panchkula, Haryana, as a sole arbitrator to adjudicate upon the disputes and differences between the parties.
