This contempt petition is filed pleading wilful disobedience of interim injunction granted under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure, 1908 (CPC).

One of the issue involved in the present petition is whether the contempt petition would be maintainable inspite of availability of remedy under Order XXXIX Rule 2 (A) of the CPC.

There is another aspect of the matter that interim order is of October, 1992 and with the flux of time, the suit must have been decided. None has put in appearance for the petitioner. The contempt petition is dismissed for non-prosecution with liberty to the petitioner to revive the same, if something survives. [AVNEESH JHINGAN] JUDGE November 20, 2019
