* * * * S.J. VAZIFDAR, A.C.J. (ORAL) CM-958-CII-2016 Leave is granted to place on record the rejoinder filed on behalf of the petitioners and the application is allowed. ARB-169-2015 This is a petition for the appointment of an arbitrator. 2.

The petition has been filed on account of the arbitrator having withdrawn himself from the proceedings by his order dated 19.08.2015. The arbitrator justifiably took offence to the contents of the petitioners' application dated 29.07.2015 (Annexure P-24) filed before him stating that the same smacks of expression of lack of faith of the petitioners in him. The petitioners have clarified that there was no lack of confidence on their part in the arbitrator. They only made certain grievances regarding the procedure. They state that they have full faith and confidence in the arbitrator and would have no objection to his passing the award. 3.

The petition is, therefore, disposed of by requesting the same arbitrator to proceed with the reference and to make and publish his award. 4.

The parties have agreed to cooperate with the arbitrator for the expeditious disposal of the matter.
