Ms. Riya Bansal, Advocate, for the respondent. * * * * S.J. VAZIFDAR, C.J. (ORAL) This is a petition under section 11 of the Arbitration & Conciliation Act, for the appointment an arbitrator.

The parties, admittedly, entered into an agreement which contains the arbitration clause. The petitioner suggested the name of the arbitrator. The respondent has certain objections to the arbitrator nominated by the petitioner. That is a different matter. The respondent is always at liberty to adopt appropriate proceedings to challenge the appointment. 3.
The petition is, therefore, disposed of by appointing Mr. Justice Anil Dave, former Judge of the Supreme Court of India, as the arbitrator on behalf of the respondent. The Arbitrator appointed by this order and the Arbitrator appointed by the petitioner's shall appoint a Presiding Arbitrator.
The learned Arbitrators shall proceed accordingly.
