Prayer in the instant petition is for grant of anticipatory bail to the petitioner in case FIR No.172 dated 09.12.2024 under Sections 296, 332(c), 115(2), 118(1), 118(2), 351(2), 191(2), 191(3) and 190 of the Bhartiya Nyaya Sanhita, 2023, registered at Police Station Nangal, District Rupnagar.

On the last date of hearing i.e. on 08.01.2025, while noticing the following submissions made by the learned counsel for the petitioner, a Coordinate Bench of this Court had granted the concession of interim bail to the petitioner and asked him to join investigation:- "Inter-alia contends that the injury attributed to the petitioner is simple in nature, the genesis of the FIR in question is only the property related dispute, civil suit between the parties is pending adjudication & the petitioner is willing to join investigation and cooperate therein."

Learned counsel for the petitioner submits that in compliance of order dated 08.01.2025, the petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions from ASI Mehar Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 08.01.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
