S.J. VAZIFDAR, ACTING CHIEF JUSTICE (Oral):

This is an application under Section 11 of the Arbitration and Conciliation Act, 1996, for appointment of an Arbitrator.

The parties had entered into an agreement which admittedly contains an arbitration clause. The parties agreed that the disputes and differences are to be referred to arbitration. They have, however, requested for appointment of a sole Arbitrator and not a panel of three Arbitrators in order to save cost and time.

Accordingly, Mr. Justice Permod Kohli, former Chief Justice of the High Court of Sikkim, is appointed as a sole Arbitrator.

The petition is accordingly disposed of.
