This petition has been filed under Section 482 of BNSS, 2023 seeking anticipatory bail to the petitioner in case FIR No.243 dated 22.11.2024, registered under Sections 305-A, 316(2), 318(4), 61 of BNS, 2023, at Police Station City Rajpura, District Patiala. 2.

On 07.01.2025, the following order was passed:- "XX XX XX XX Inter-alia contends that the petitioner is a lady aged 50 years; petitioner's husband is the main person against whom allegations have been raised, the petitioner's husband and the complainant side are interlocked in various property related litigations & the petitioner is willing to join investigation and cooperate therein. In order to buttress his arguments, learned counsel for the petitioner has relied upon the dicta of the judgements of the Hon'ble Supreme Court in the case of 'Md. Asfak Alam versus The State of Jharkhand and another' 2023(3) R.C.R. (Criminal) 754 and Arnesh Kumar versus State of Bihar (2014) 8 SCR 128.

The petitioner is directed to appear before the Investigating Officer on 10.01.2025 at 11:00 A.M. in concerned Police Station and join investigation. In the event of arrest, the petitioner shall be released on interim bail subject to her furnishing personal/surety bond(s) to the satisfaction of the Arresting Officer/Investigating Officer. As and when further called by Investigating Officer, the petitioner shall join the investigation. She shall abide by the condition(s) enumerated under Section 482(2) of BNSS, 2023."

Learned State counsel, on instructions from ASI Lakhwinder Singh, at the very outset, informs the Court that the petitioner has joined the investigation and his custodial interrogation is not required.

In view of the statement of learned State counsel, order dated 07.01.2025 is hereby made absolute. The petitioner shall abide by the terms and conditions envisaged under Section 482(2) of BNSS (erstwhile Section 438(2) of the Code of Criminal Procedure, 1973). 5.

The petition stands disposed of.
