(ORAL) Prayer in this petition is for grant of anticipatory bail in FIR No.433 dated 26.10.2020 under Sections 307, 341, 323, 506, 148, 149 IPC, registered at Police Station City Barnala, District Barnala. While granting interim bail to petitioner No.2, following order was passed by this Court on 02.02.2023: - "Learned counsel for petitioner No.2 submits that the matter has been settled between the parties.

Notice of motion for 24.04.2023.

In the meantime, petitioner No.2 is directed to appear before the Investigating Officer within a period of 10 days to join VISHNU 2023.04.24 15:46 I attest to the accuracy and integrity of this document Punjab and Haryana High Court, Chandigarh

CRM-M-1842-2023 -2investigation and he shall be released on interim bail on furnishing bail/surety bonds subject to the following conditions:-

1. He shall make himself available for interrogation by a police officer as and when required;

2. He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; and

3. He shall not leave India without previous permission of the Court."

Learned counsel for petitioner No.2 submits that in pursuance of the aforesaid order, the petitioner has joined the investigation and is not required for any further investigation.

Learned State counsel, on instructions from the Investigating Officer, has not disputed the factual position and states that the petitioner is no more required for any further investigation.

In view of the above, this petition is allowed and the interim bail granted to petitioner No.2 vide order dated 02.02.2023 is made absolute subject to the conditions envisaged under Section 438 (2) Cr.P.C., as petition qua petitioner No.1 Gurdit Singh already stands dismissed as withdrawn.
